September 12, 2006 11:42am I called Tessa at her parent's to talk to Payton. Tessa had a lot to say and then said Payton is asleep. I told her I would call back. 12:59pm I called back and the answering machine came on and I left a message. 1:24pm Tessa called me so I could talk to Payton and said I am only calling to talk to Payton because the attorney said to. September 26, 2006 Tessa posted a blog in her Myspace.com account showing her bad attitude towards West Virginia which is where I was born and raised. The post is very slaunderous. (Document)

October 1, 2006 7:30am I called Tessa at her parent's before leaving to go to NY. I called to let them know that I was taking Payton over-night like the judge said I could do. I told them I would pick her up around 8:00pm and have her ready. (Documented Notebook Entry)

October 2, 2006 (Visit with Payton)Court hearing. Myself and my mother decided to go to New York in person instead of over the phone. We were given permission by the Judge to take my daughter, Payton, to West Virginia for a visit at my mother's house where I reside. We were to pick her up at Scotia Police Dept, NY and bring her back to the same place on Oct. 15, 2006. The judge said Tessa could call and talk to Payton any time she wants.

October 2, 2006(evening) When we went to pick up Payton at the Scotia Police, Tessa and her parents were very irrate and unreasonable. When we got the car seat out of the trunk they hollered that it was not fit for her age. We told them we would go to Walmarts and get one. They said we would have to go get it first. so we went to Walmarts and back. They were still being uncival and hateful but we finally got the baby and her stuff and left. (Documented Notebook Entry)

~5:27pm Tessa called to tell me how SHE wanted the sleeping arrangements done for Payton. She tried to talk to Payton but she was playing and wouldn't talk to her much. (Documented Notebook Entry)

~8:30pm Tessa called while I was reading Payton a story and getting her quiet for bed time. My mom told her that but she got mad and had a lot to say to my mom and then demanded she talk to Payton.........(Documented Notebook Entry)

October 4, 2006 10:05am Tessa called to talk to Payton while I was gone to work. My mom told Payton "it's mommy, talk to mommy" Payton said "no" and then Tessa threw a fit on my mom......(Documented Notebook Entry)

~12:30pm Tessa called to talk to Payton and decided to just hand the phone to Payton when she calls and say "It's for you, Payton! It's mommy!" After four minutes of Payton putting the phone down and my mom handing it back to her, Tessa had hung up. (Documented Notebook Entry)

~4:00pm Tessa called while my mom was gone to pick up my sister (Heather) and left a message on the answering machine. (Documented Notebook Entry)

~4:42pm Tessa called to talk to Payton. Heather answered and gave the phone to Payton. Payton kept laying the phone down, pushing buttons, put it to her ear, on and on like that and then Heather listened after 7 minutes and Tessa was not there. (Documented Notebook Entry)

~6:05pm Tessa called and my mom gave the phone to Payton and told her it's mommy. Heather listened when Payton layed it down and it was also Tessa's parents (Ike and Josaphine) Heather heard Ike say "don't be surprised if you see socil services come knocking at your door." Tessa said "Have fun with your little two weeks. I HAVE FULL CUSTODY! Ha ha ha" Ike said "hahahahahahaha....They were all just going on and on while no one but Payton was listening when she wasn't throwing the phone, kicking it around, sitting on it.......(Documented Notebook Entry)

October 5, 2006 8:57am Tessa called and I put the phone to Payton's ear and said to talk to mommy. Then I thought she might want to ask how Payton is doing, but she started right up and said the judge said she can call anytime she wants, and was going on and on and on so I hung up and she never did ask about Payton....(Documented Notebook Entry)

October 5, 2006 Letter I faxed to my attorney, Clara Vilsa, along with my printed documented notebook entries of Tessa's phone harrasment. In the letter I asked that I have a more peaceful visitation with my daughter.(Document)

October 5, 2006 While I had visitations with my daughter, Tessa filed a Summons...Violation of Court Order....Family Court of the State of NY County of Schenectady...File#: ####...Docket #: V-#########...Her statement is flawed by untruths and twisted truths. She said she was told that she could call any time she wants. She claimed that SHE is harrassed by myself and my family when she calls to talk to Payton. She claimed that I hung up on her while she was talking to Payton and that my mother told her that Payton doesn't love her and doesn't want to talk to her. ~6:58pm Tessa called and same thing.....Heather listened when Payton layed down the phone and heard Josaphine say that the law guardian says they can speak to an adult. So my mom said "hello' and they asked her why I was not there. My mom told them I was at work. They asked what time do I get home. My mom said about 8:30pm. they said to tell me to call when I get home. I got home early at 8:00pm but did not call them because I knew they just wanted to argue. (Documented Notebook Entry)

~8:54pm Tessa called and I didn't answer. Payton was asleep. She left a message to call her on her cell phone and sounded civil. I figured the attorneys have told her to quit harassing us, so I called her back. She asked about Payton and every time she started to make a sarcastic remark....someone was there stopping her. November 16, 2006 9:18pm Tessa called and Payton was not in bed so I talked to Payton. Then Tessa got on the phone with her visitation plan and I told her mine and she did not want to agree to it or the times or the meeting halfway. I told her it's up to the judge. Her and her dad went on and on about how I should not have left New York and because I did I have to come all the way there to pick up and bring back Payton. Ike said I could have stayed there in NY....My mom got on the phone and told her dad that normal people don't live with their X-in-laws....he talked over top of my mom so we hung up....(Documented Notebook Entry)

November 16, 2006 Child Support court hearing postponed to Jan 23, 07

November 16, 2006 Me and my mom had a conversation with Tessa and her Dad(Ike). Showing their harrasment and wanting to badger us constantly. Also we talked about our ideas for visitation, which of course Tessa was being unrealistic and disagreeable about. My mom also recorded the conversation on video recorder and wrote down what was said too.(document)

November 20, 2006 (Visit with Payton) Hearing in NY at 1:30pm...Myself and my mother appeared in person. We were given permision to take Payton to West Virginia for a visit and bring her back around Dec. 12, 06 and bring her halfway at whatever time we both agree on. We were to pick up Payton at the Scotia Police Station at our request. Just as we thought would happen...the courts opened a door for Tessa to be disagreeable and unreasonable....leaving it up to us to agree to the date, time, and place. I had been saying Chambersburg was the halfway point from the very first court hearing and I said 3:00pm was a reasonable time of the day.....So myself and my mom stuck with that but Tessa wanted to argue about it all. It was cold outside and Payton was getting hungry and cold. but Tessa would not let us take the baby until she got her way. Her and her parents (Ike and Josaphine Jarr) decided that Chambersburg was not halfway between where I lived and where she lived. She wanted to give me less time for the visit and she wanted us to drag the baby out of the bed at 4:00am on the day to meet halfway to meet her at 10:00am, and she wanted to meet at a McDonalds somewhere in Harrisburg PA and she would flag us down on the interstate. I finally agreed on Dec. 7, 06 but tried to reason with her on the rest and was unsucessful....I just barely agreed to her terms so that we could take the baby and get on our 600 mile trip back home. A couple days after we got home I faxed a letter about it all to my attorney and we waited till almost the end of my visit to tell Tessa that we are going to compromise and meet her at the Police Station in Mechanicsburg PA, on Dec 7, 06 at 2:00pm. She was very angry but we told her that's how it's going to be OR we will just bring the baby all the way to NY at the next hearing. I called the Law guardian, Mr. Straight and he agreed that she was being unreasonable and said he would call her and set her straight. Then he called us back with a whole different attitude after being manipulated by Tessa and told my mom that we have to agree on everything. My mom told him that Tessa will not agree and that he needs to tell her how it should be done. He would not and we decided to ahead with our original plan and take our chances. ~4:02pm Tessa called while we were on the road. I told her that Payton did not sleep well because of her constipation problem and she needs prune juice when she gets that problem. ~8:40pm Tessa called my house while I had Payton at my grandparent's house in the next town up. My brother answered the phone and told her that we went to the parade and wasn't back yet. She told him that I wasn't suppose to call from my mom's cell phone. and then she said "What kind of a parade lasts that long?" (Documented Notebook Entry)

~8:45pm Tessa called my house again while we were on our way home from the parade. She left a message that we are not suppose to have Payton out that late. Payton fell asleep on the way home and Tessa never bothered to call me back on the cell phone when I called at the normal time. (Documented Notebook Entry)

November 29, 2006 8:32pm Tessa called but I was busy helping Payton brush her teeth and didn't answer the phone because I was suppose to be calling HER. Not her calling me. (Documented Notebook Entry)

~8:34pm I called Tessa back and of course she went right into the arguing about why didn't I call Monday(Nov 27, 06) I told her I took Payton to the parade. December 6, 2006 1:24pm Tessa called and left a sarcastic and threatening message. Calling to say she would have us all arrested if we don't bring Payton back at the time, day, and place she wants......(Documented Notebook Entry)

~1:35pm My mom called her back to tell her that we will meet her at Mechanicsburg PA at 2:00pm. Tessa got angry and kept saying how she wanted it done. My mom told her that her place is not halfway, she does not even have a specific place and we are not draging Payton out of bed at 3:00 in the morning to get her there at her unreasonable time. Come and get her the time and place we compromised to OR we will just bring her the next court day.........My mom called my attorney, but no answer and she left a message. She called Tessa's attorney and same thing. She called Mr. Straight (Law guardian for the child) He answered and after she explained, he said our plan was more reasonable and he said he was going to call Tessa and tell her to do it our way. He told my mom to call him back in an hour. When my mom called back his whole attitude had changed and he said that me and Tessa have to come to an agreement. My mom told him that Tessa does not EVER agree to anything. It has to be HER way or nothing and her way is not reasonable. ...(Documented Notebook Entry)

December 7, 2006 (Took Payton back halfway) Myself, my mom and my grandfather took Payton back halfway. We had many phone calls and threats from Tessa and her parents from the time we were leaving to right up to the time of meeting her about the time and halfway point and place but we stuck with it and she finally showed up, ran over to the car like a tornado, grabbed the baby out of the car seat and didn't even wait to get some of the baby's things.....(Documented Notebook Entry)

December 7, 2006 7:22am Tessa called when we were going out the door to head to Pennsylvania to take Payton back halfway. She left a message and said we have to meet her in Harrisburg at the first exit (probably HER first exit) since we did not agree on anything...(Documented Notebook Entry)

~12:38pm She called again and my brother answered. She told him to tell me to meet her in Harrisburg at the Taco Bell.

~2:00pm Myself, my mom, my grandfather, and Payton were almost to the police station in mechanicsburg Pennsylvania (which is more than halfway for us) and we called Tessa on my mom's cell phone to tell here we are almost there. she said no she is not coming there. We said be there or see you in court. We arrived at 2:15pm, she showed up at 2:22pm and jumped out of her car, grabbed Payton out of our car, got in her car and told her friend to lock the door. She didn't take the baby's blanket, pillow, or sippy cup and I didn't get to say good-bye to my daughter..(Documented Notebook Entry)

December 11, 2006 8:06pm I called Tessa to talk to Payton and her and her parents all had plenty to say. They said Payton has flea bites all over her. I told them she had that rash when I brought her here. they went on and on and on ...I finally got to talk to Payton. (Documented Notebook Entry)

December 18, 2006 3:52pm Tessa called and left a message in a sarcastic tone of voice that she had the court hearing postponed because of manditory inservice. She said she is having Payton for Christmas and I could come there and pick her up after Christmas and keep her until the next court hearing. ~7:26pm I called Tessa to talk to Payton and finally she answered the phone. I talked to Payton for a few minutes and then Tessa started talking. she said I could come there and take Payton and bring her back at the next court date. I told her I will just bring her home at the next court hearing. She said "Only if they let you." I said: "Oh, they should." Then she talked about a rash Payton has and said because my mom has exema, she thinks that is what Payton has. I asked her if she has taken Payton to the doctor yet, she said "no". I told her we would send some lotion that my mom uses but she still needs to take her to the doctor. I talked to Payton some more....(Documented Notebook Entry)

January 2, 2007 8:30pm I called to talk to Payton but the line was busy. I tried again and still busy. I tried Tessa's parents house and it was busy too. I tried for 15 minutes but the lines stayed busy. (Documented Notebook Entry)

On the criminal case: The Assistant DA, Greggrey Surgefon, got a DUI and was forced to resign his position with the DAs office. The new assistant DA is Derick Swinker Esq. and is not up to speed on my case. Mr Belly also said that he was given permission to appear at the hearing July 16, 07 on my behalf. And asking for adjournment on Aug. 6, 07 which is the same date for the family court trial.
Family Court case: He met with Tessa's attorney Mr. Slyree, Esq, the county attorney (Sharon Mudd), Judge's Law Clerk, and Payton's Law Guardian. The report from the Mercer Day Report Center (Mrs. Jones) on my drug and alcohol dependency was not good enough and asked me to call them and ask them to send a clarification on the findings and conclusions to NY. Also the County attorney made me an offer. He said Tessa declined to join the drug court she was offered. He said I said the word "CHOKE" and the County attorney says she has a case against me because of that. (document)

October 29, 2007 Divorce trial took place in the Family Court of Mercer County, West Virginia. Judge: Drifton. Tessa did not show up. The judge asked me about the grounds for divorce I had alleged mental and physical abuse by my wife Tessa. Judge called my mom into court room as a witness of the abuse. My mom said that we had lived together at her home for a while and visited together. Also after I went into the military, I would call her often and report to her the abuse I was going through, including Tessa's false harrasment charges, infidelity, drug use, abandonment....The judge said I would have to get my big screen TV and payment of half the bills from Tessa by using the divorce papers and possibly filing complaints in New York.

November 11,2007 Plea to a Misdemeanor Criminal contempt 2nd Offer from the DA...I received a letter from my attorney, Slob Belly, explaining the DA's offer on the criminal case. It is the very same thing as the first offer only the Order of Protection can be modified or dropped if circumstances (like visitation) require. I would have to attend a program in WV similar to MOPS (Batter's Intervention and Prevention Program...Mercer County Day Reporting...Princeton WV) As with the first plea bargain, Tessa is the victim and stabbed me "in a defensive manner" But I still say she stabbed me "IN A PSYCHOPATHIC MANNER" busting through the screen door after me and getting scratches on her arm from doing that, like it says in the police report that my attorney latched on to at the last hearing and now I only have a copy of it instead of the original. November 17, 2007 My notarized statement "Accepting the Plea Offer" I faxed to my attorney to make a part of my agreement to accept the offer from the DA. I said in the statement that I accept the offer on the fact that I broke the law by going against the Order of Protection and for THAT FACT ONLY. I told my attorney to make sure this statement becomes a part of the court proceedings and part of the plea bargain. I also mailed the original notarized statement to my attorney along with a letter explaining. (Documents)

November 21, 2007 5:55pm Wednesday....Teresa called my mom's house and said that she is on a road trip with Payton going to her parents and is at a rest stop for a few minutes if my mom could call soon before she gets out on the busy highway.

November 22, 2007 My mom called Poor McNutt, Joe DeVil, and my attorney Slob Belly and left messages to call her back and let her know what is going on

Dec. 3, 2007 and why neither of us have received a hearing notice. Joe DeVil called back and said it is a "Permanency Hearing" on Payton. My mom told him that she is fully approved for foster care now and should be able to bring Payton to West Virginia to live. She told him that the judge said in the last hearing that Nov. 26 he would decide where Payton goes, so why would there be another hearing a week later? He said he does not know what the judge will decide and can't be for sure if that hearing on Dec 3 will even take place or not...we will know more on Nov 26. He said for my mom to have WV Foster care to fax the proof of her being approved because they don't have it yet.
